GENERAL CONTRACTING CONDITIONS
This contractual document will govern the contracting of products and services through the website www.bookmima.com , owned by Mireia de la Corte Escobar with DNI number 47908945Z, address at Av. Diputación 23, 08796, Barcelona, with email address info@bookmima.com (hereinafter, the PROVIDER).
Acceptance of this document implies that the USER:
- You have read, understand and comprehend what is stated here.
- It is a person with sufficient capacity to contract.
- Assume all obligations set forth herein.
These conditions will have an indefinite validity period and will be applicable to all contracts made through the website www.bookmima.com
PURPOSE OF THE CONTRACT
The purpose of this contract is to regulate the contractual relationship of sale between the PROVIDER and the USER.
1. GENERAL CONTRACTING CLAUSES
Unless otherwise stipulated in writing, placing an order with the PROVIDER will imply acceptance by the USER of these legal conditions.
No stipulation made by the USER may differ from those of the PROVIDER unless it has been expressly accepted in advance and in writing by the PROVIDER.
These Terms and Conditions, together with the Website's Privacy Policy and Legal Notice, are the only conditions applicable to the use of the Website and the purchase of products through it and replace any other conditions.
Consequently, any User who accesses the Website and purchases products through the Website agrees to submit to and be bound by these Terms, the Privacy Policy, and the Legal Notice as written at the time of accessing the Website.
Every User who registers on the Website must be at least eighteen (18) years old.
2. SHIPPING ORDERS
Shipments are made by courier service.
Shipping costs always include Value Added Tax (VAT), but no other taxes, fees, customs duties, tariffs, or surcharges.
The PROVIDER will not send any order until it has verified that payment has been made by the USER.
Shipping to mainland Spain takes approximately 48 business hours (Monday to Friday) once payment has been confirmed. This is excepted during sales, promotions, or Black Friday, when this time may be longer.
For international shipments, delivery times can be 5 to 10 business days (Monday to Friday), depending on the destination and the shipping company indicated. This is excepted during sales, promotions, or Black Friday, when this time may be longer.
Once the package is delivered to the courier service, the USER will receive an SMS or email with the tracking number. The PROVIDER will not assume any liability if the delivery of the product or service is not completed due to false, inaccurate, or incomplete information provided by the USER. In these cases, the PROVIDER will refund the price of the products, but not the corresponding shipping costs.

Delivery will be considered complete when the carrier has made the products available to the USER and the USER, or his or her representative, has signed the delivery receipt.
3. RIGHT OF WITHDRAWAL
The USER will have a maximum period of fourteen calendar days to withdraw, starting from the day the customer receives the product.
The right of withdrawal must be exercised by sending an email to info@bookmima.com
Unless the return is due to a product defect, the PROVIDER will refund the customer the amount of the returned product less return shipping costs. The product must be returned in its original packaging and in perfect condition.
Under no circumstances may changes and/or returns be made for purchases of personalized products.
The right of withdrawal cannot be applied in the following cases:
- 1. If the product is not presented in perfect condition.
- 2. If the product packaging is not original or is not in perfect condition.
- 3. When the product is opened without proof that it has not been used.
- 4. When they are personalized products.
The user will not be able to cancel an order once it has been confirmed.
4. CLAIMS

5. RIGHT TO NOT ACCEPT AN ORDER
The PROVIDER may cancel any confirmed order or refuse to accept an order placed for the following reasons:
- In the event of a technical error and/or typographical error in the prices or other product information contained on the Website when the order was placed.
- Due to lack of availability.
- When security systems indicate that the order may be fraudulent.
- When there are reasons indicating that the client is a minor.
- When the PROVIDER has not been able to deliver the order to the address provided by the customer.
- If there is a computer attack, virus or any event that is beyond reasonable control (force majeure).
- In case of a payment error.
In such cases, the PROVIDER will fully reimburse the amounts that have been paid.
6. FORCE MAJEURE
In the event that, due to circumstances beyond our control, a product is unavailable after the purchase has been made, the PROVIDER will inform the User by email of the total cancellation.
The PROVIDER is not responsible for delays in delivery of orders, or for the inability to fulfill them when the cause is due to force majeure, and therefore beyond our control. Among other causes, we understand that force majeure exists in the following cases, but not limited to: accidents; strikes; riots; terrorist threats or attacks; fire or explosion; meteorological causes or natural disasters such as storms, floods, earthquakes, subsidence, or epidemics; problems beyond our control with transportation or telecommunications systems.
To the extent possible, once the cause of impossibility or delay has ended, the PROVIDER will do everything possible to resume its business activities and be able to fulfill its obligations and deliveries.
7. COMPETENCE
The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted in the sale.
Should any provision of these terms and conditions be held invalid or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected in any way, nor shall they be modified in any way.
The USER declares that he or she has read, understood and accepted these General Conditions in their entirety.
8. GENERALITIES OF THE OFFER
All sales and deliveries made by the PROVIDER shall be deemed subject to these General Conditions.
9. PRICE AND VALIDITY PERIOD OF THE OFFER
The prices indicated for each product include Value Added Tax (VAT) or other applicable taxes. Unless expressly stated otherwise, these prices do not include shipping, handling, packaging, shipping insurance, or any other additional services or additions to the product or service purchased.
The prices applicable to each product are those published on the website and are expressed in euros. The user assumes that the economic value of some products may vary in real time.

11. PAYMENT METHODS, FEES AND DISCOUNTS
The accepted payment methods are:
1. PAYPAL:
The USER will be redirected to the PayPal website, using its secure payment platform. Once the payment process is complete, they will be redirected back to the PROVIDER's website. Once on PayPal, they can make the payment using a PayPal account or credit card. Cash on delivery payments are never accepted through the PayPal website.
PayPal may retain an amount as a deposit or insurance when attempting to make a purchase with your card on the PayPal platform. Charging this amount does not guarantee that the purchase will be completed.
2. VISA, VISA OR MASTERCARD CREDIT or DEBIT CARD.
All transactions involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology.
All information you transmit to us travels encrypted over the network. Likewise, your credit card information is entered directly into the bank's website, using the POS (Point of Sale Terminal), and is not entered or recorded on any of the PROVIDER's servers.
When paying by VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD. This provides additional security for your transaction.
12. APPLICABLE WARRANTIES
All our products come with the supplier's commercial warranty. Therefore, if the product is defective, the SUPPLIER will be responsible for collecting it and exchanging it for the correct one, covering the costs associated with this return and exchange.
In order to manage the incident, we need you to notify us by email at info@bookmima.com indicating:
The reason for the incident, the order number (essential for locating the purchase), the delivery note, and photos of the damaged or defective product so we can assess the situation. To exercise your warranty rights, you must have proof of purchase or the delivery note.
It is important for you to know that our warranty does not cover:
- a) Negligent or violent use of the product.
- b) Damage resulting from manipulation or intervention of the product.
13. RETURNS
The first return by Size exchanges are free in mainland Spain . The deadline for exchanging a size is 15 days from receipt of the order.
In the return by product exchange or refund The customer will be charged for return shipping costs. The deadline for product exchange or refund is 15 days from receipt of the order.
If the USER requests a refund, it is not immediate. It may take up to 2-3 days, depending on the bank.
Customized products, custom-made products, and mobile phone cases provided by the customer cannot be returned.
During the sales of Black Friday, 3-for-2 Special Offers, Sales Season, or Discounted Products, return shipping costs will be borne by the buyer, with an amount of €6 for size/product exchanges and €5.00 for a refund.
In all cases, the products to be returned must be in perfect condition, unused, and in their original packaging. Therefore, to avoid problems during transport, please ensure that the package is properly protected and sealed. Once received, we will check their condition. Once we verify that both the item(s) and any components and accessories are complete and in perfect condition, we will refund the money paid for the purchased products or send the new product for which the return is being made.

14. APPLICABLE LAW AND JURISDICTION
Likewise, the PROVIDER reserves the right to file any civil or criminal actions it deems appropriate for improper use of its website and content or for non-compliance with these conditions.
The relationship between the USER and the PROVIDER shall be governed by the regulations in force and applicable in Spain. Should any dispute arise, the parties may submit their disputes to arbitration or resort to ordinary jurisdiction, complying with the rules on jurisdiction and competence. The PROVIDER is domiciled in Vilafranca, Spain.
Products with a discount on their original price
Products with a discount on their original price are all those purchased with discount codes, with a catalog discount on their original price during the period indicated above.
Changes
Only one exchange for these products will be allowed for another size (larger or smaller, regardless of the size) of the same product purchased or a different product. More than one exchange is not possible for the same product. If the requested size exchange is not possible, for any reason, either for the product's own or for any other reason, the product will be returned for the full amount paid for the product, excluding the amount paid for "Shipping." The exchange period for these products is 14 calendar days from the date of receipt of the order. To be exchanged, the product must be in perfect condition (unused) and retain its original packaging.
